ESPIRITU NG BATAS

KUDOS SA MATATAG ang paninindigan ni PNoy:  “Hindi ako papayag na apihin ang sambayanang Pinoy!” Ito ang kanyang tinuran matapos ideklara ng sham na hurado (bukod kay Chief Justice Corona), na labag sa saligang batas ang Executive Order (EO) No.1 – lumikha ng Truth Commission. 

Ang kanilang (mga Hurado) matunog na argumento (o argagomento), nilabag ng naturang EO ang “Egual Protection Clause” ng 1987 Saligang Batas ng Pilipinas kung saan ito ang nakasaad: “ARTICLE III BILL OF RIGHTS Section 1. No person shall be deprived of life, liberty, or property without due process of law, nor shall any person be denied the equal protection of the laws.” 

Sa ating wika natin: “Walang sinuman ang maaring pagkaitan ng BUHAY, KALAYAAN, o PAG-AARI nang walang kaukulang proseso alisunod sa batas. 
Ano naman ang DUE PROCESS, o kaukulang prosesong alinsunod sa batas? Bunsod ng EO, mapagkakaitan ba ng due process ang dating pangulo?
Sa maikling salita ito ay mahigpit na utos ng MAKAPANGYARIHANG MAMAMAYAN FILIPINO (the Sovereign Filipino People) sa pamamagitan ng saligang batas, na bigyan ng kaukulang ABISO at PAGDINIG bago HATULAN, ang sinumang akusado o pinararatangan ng anumang paglabag sa batas. Ito ba ay MAKATARUNGAN para sa lahat? Opo. 

Ito ba ay makatarungan para sa dating pangulong Gloria Macapagal-Arroyo? Ito ba ay makatarungan para sa sambayanang Pilipino? Matunog na argumento ba ang naging batayan ng Korte Suprema sa paggawad ng KATARUNGAN o ito ay isang ARGAGOMENTO DE BOBO? 

Para maliwanagan tayo, kilatisin po natin kung anong klaseng hayop nga ba ang “EQUAL PROTECTION CLAUSE.”

BANAL NA KARAPATANG MAGHARI (Divine Right to Rule). Ito ang kalakaran noon sa marami panig ng mundo. Ang hari ay walang pananagutan sa kahit sino dito sa lupa dahil siya ay itinakda ng Dakilang Arkitekto ng Sanlibutan. Lahat ng tao sa kanyang nasasakupan ay mga alipin lamang. Hindi uso ang KARAPATANG PANTAO. Ito ang umiiral na situwasyon sa pagitan ng Great Britain at America noong sinaunang panahon. Kahalintulad din ng situwasyon ng ating bansa at ng bansang Espanya na sumakop sa atin noon, sa loob ng mahigit tatlong siglo.

NAPUNO NA ANG SALOP. Hindi na kinaya ng mga mamamayang Amerikano ang PAGKA-AROGANTE, PANGUNGULIMBAT, PAGYURAK sa kanilang pagtakatao at samo’t sari pang kaapihang natamo ng kanilang lipi. Isang Amerikanong tumutugon sa pangalang Patrick Henry ang nanindigan ng: “GIVE ME LIBERTY, OR GIVE ME DEATH!” Ibigay ninyo ang aking KALAYAAN, o ibinigay ninyo ang aking KAMATAYAN, aniya. Nagkaisa ang mga Amerikano at kanilang ideneklara ang kanilang kalayaan noong July 4, 1776. Ano ang kanilang batayan?

IBINASURA nila ang pangguyong BANAL NA KARAPATANG MAGHARI kapalit ng paniniwalang ”ALL MEN ARE CREATED EQUAL.” Ang paniniwalang ito ay siyang naging puso ng DEMOKRASYA: “We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness. That to secure these rights, Governments are instituted among Men, deriving their just powers from the consent of the governed, That whenever any Form of Government becomes destructive of these ends, it is the Right of the People to alter or to abolish it, and to institute new Government, laying its foundation on such principles and organizing its powers in such form, as to them shall seem most likely to effect their Safety and Happiness.”

MASAKLAP nga lamang, hindi napangatawanan ang PAGKAPANTAY-PANTAY na siyang pondasyon ng kalayaan ng Estados Unidos. Maraming pa ring alipin (Black Americans) sa America makalipas ang maraming taon ng kasarinlan. Kaya noong July 9, 1868, sa ika-14 na pagkakataon, muling sinusugan ang saligang batas ng Estados Unidos at dito na lumutang ang “EQUAL PROTECTION CLAUSE.” Maraming batas ang binaliktad. Ang pagbabawal sa isang Negro na mapasama sa Jury, ang diskriminasyon laban sa mga Intsik sa negosyong paglalaba, ay ilang lamang sa mga naituwid ang landas.

DATAPWA’T nagpatuloy pa rin ang pagdapurak sa karapatan ng mga de-kulay ang balat na mga Amerikano. Si James “Jesse” Cleveland Owens, isang di pangkaraniwang atleta na African American na humakot ng Apat na Medalyang Ginto matapos magtatag ng tatlong world records at pantayan ang isa pa sa 1936 Berlin Olympics, ay ni hindi magawang imbitahan at parangalan sa White House ni Franklin Delano Roosevelt na noon ay pangulo ng Estados Unidos. Gayundin ang successor nitong si President Harry S. Truman. Bakit? 

Dahil sa diskriminasyon. Ayaw talagang intindihan o unawain ng karamihan ang “EQUAL PROTECTION CLAUSE.” Dapatwat kahit manuwari’y nagkaroon din naman ng testimonial dinner, parangal para kay Jesse, ngunit matapos siyang pagsalitain agad siyang pinalabas sa venue. Ni hindi siya maaring maupo man lamang lalo’t higit kumain, sa Testimonial Dinner in his honor. 
Hindi nila matanggap na kapareho nila, mga anak din ng Diyos ang mga African Americans at iba pang de-kulay ang balat na mga ipinanganak o naturalays nang mamamayan ng Estados Unidos. Parang tayong mga Pilipino din sa panahon ng kastila. Hanggang ngayon ganoon pa rin ba?

NASAKSIHAN mismo ng noon ay pangulo ng US, President John F. Kennedy, kung gaano ka marahas binuwag ang rally na pinamumunuan ni Martin Luther King. Na imbento na kasi noon ang telebisyon. Kaya sa kanyang civil rights speech noong a-11 ng Hunyo 1963 humirit siya ng isang batas na magbibigay diin sa pagka PANTAY-PANTAY sa karapatan ng lahat ng mamamayang Amerikano, anuman ang kulay ng balat nito.

Ang panukala, gaya ng inasahan ay mahigpit na tinutulan sa kongreso. Ngunit, makaraang mapaslang ang pangulo noong taon ding iyon, at bilang pagbibigay-pugay na din, kasama na rin ang kaukulang respeto, nalagdaan ni President Johnson noong July 2 ang: “The Civil Rights Act of 1964.”  

LAYUNIN ng EO Numero Uno na lumutang ang KATOTOHANAN. Ang EO ay pabor din sa panig ng dating pangulong Gloria Macapagal-Arroyo, kung totoong malinis ang kanyang budhi. Muntik ko nang masabing “ayon sa kanya,” ngunit bigla kong naalalang ni minsan ay hindi niya pa TAHASANG ITINANGGI ang mga paratang laban sa kanya. At least, wala akong maalala. Maging ang kanyang mga kaalyadong kagaya ni Congressman LAGYAN (erratum: Lagman) ay hindi ko rin nakaringgan ng ganun.

MAGKATUNGGALI sa usaping ito (pagpapalutang ng katotohanan) ang dating Pangulo Gloria Macapagal Arroyo, et al, sa isang banda at ang SAMBAYANANG PILIPINO sa kabilang panig. KATAKOT-TAKOT na salapi sa kaban ng bayan ang ninakan (sa gitna na labis na kahirapan ng karamihan sa mga Pinoy)  diumano ng dating pangulo sampu ng kanyang mga kampon. Iyan po ang isyu sa usaping ito. Ang Kataas-taasang Hukuman (hindi KAGULANG-GULANGAN) naman ang siyang pinal na Referee.

NAKATALA na sa ating kasaysayan na kaya napa-upo sa puwesto ang dating pangulo (GMA) dahil sinabi ng Referee na nag bitiw na sa puwesto ang noon ay duly elected president, Erap Estrada. Tinawag nila itong ”CONSTRUCTIVE RESIGNATION.” Hindi natin alam iyon at huwag na ninyo hanapin kasi wala ito sa saligang batas. 

EXECUTIVE PRIVILEGE naman ang kanilang pauso para huwag malitis at manatili sa puwesto ang noon ay nakaupo (ngunit isinusuka na ng sambayanang Pilipino) nang pangulong GMA, laban sa mga aligasyon ng PAGNANAKAW NG KUWARTA ng kaban ng bayan, at pagnanakaw BOTO ng mamamayan sa halalan, at iba pa. 

Ika nga ni Ms. Susan Roces: “YOU STOLEN THE PRESIDENCY NOT ONCE BUT TWICE,” kay GMA.  

KAPWA KO PINOY, ang “EQUAL PROTECTION CLAUSE” sa kasayasayan ng demokrasya sa United States of America, na ating kinopya, sa bao ng buko (in a nutshell), ito ang ay pananggalang ng mga maliliit laban sa MALALAKI. Panangga ng mga mahihina laban sa mga MALALAKAS. Proteksyon ng mga napaglalamangan laban sa mga Ganid, Manhid, at Abusado. Proteksyon ng mga langgam laban sa mga BUWAYA. 

NAWAGLIT, hindi lamang sa isang saglit, sa isipan ng sham na Hurado (excluding the CJ) ang ARTICLE XI sa saligang batas: ACCOUNTABILITY OF PUBLIC OFFICERS, kung saan nakasaad – Section 1. Public office is a public trust. Public officers and employees must, at all times, be accountable to the people, serve them with utmost responsibility, integrity, loyalty, and efficiency; act with patriotism and justice, and lead modest lives.

MALINAW sa hatol ng Korte Suprema na kinakailangan nilang protektahan ang isang langgam laban sa isang buwaya. Ang LANGGAM sa paningin ng Kataas-taasang Hukuma sa usaping ito ay walang iba kung hindi si GLORIA MACAPAGAL-ARROYO. At, ang BUWAYA ay ang SAMBAYANANG PILIPINO. sa ayaw man natin o gusto.
