If we will enact the jury system law with its provisions as proposed in the draft in the web site below, the Filipino people could easily indict any grafter with the crime of obstruction of justice which is easier to prove than the crime of bribery or perjury.

Example:  If a giver in bribery is subpoenaed with an offer of immunity from prosecution to appear as a witness in bribery against the recipient (public official) to testify before a grand jury for investigation and he disobeys the subpoena, then the giver may be charged for obstruction of justice and land in jail.   If the same witness testifies but lies in his testimony, he can also be charged with obstruction of justice which is also easier to prove than perjury. Either way he will serve in jail upon conviction by the trial jury.

But who do you think will refuse to testify if the briber giver is threatened with an imminent conviction and imprisonment for obstruction of justice?  I think, he will testify instead against his recipient.  If so, then it will be very easy to convict the recipient of the bribe.

REACTION TO COLUMN ON QC DECISION: An advocate pushing for the jury system of trial in the Philippines sent this to me through e-mail, in reaction to our item on the decision of the Quezon City Metropolitan Trial Court, Branch 43, against me: "It's a no brainer.......that there is some collusion/bribery going on, and that's the problem with Phl justice. 

"If the Phl have (sic) a jury system, both sides can battle any case based on the law, law of evidence/s, and whoever has the most compelling argument, wins the case. All the judge has to do is give jury instruction that covers the law violated and the correct remedy for the injured party (Rick Bernabe, dlrkng884853@yahoo.com)."


LEGAL JUSTIFICATION FOR AFP MONTHLY ALLOWANCES: The Inquirer interview with a retired AFP chief of staff under former President Arroyo, conducted by veteran political affairs reporter Christian V. Esguerra, could constitute a legal justification for giving millions of pesos in "monthly allowances" to any AFP chief, thereby giving a lie to claims of plunder and corruption by Lt. Col. George Rabuza.

Indeed, with the awesome responsibilities of a chief of staff, which are not unlike the awesome responsibilities of a President of the Philippines, where would the chief get the money to function effectively? The President has his funds coming from the PAGCOR and the PCSO, but the AFP chief does not have that.


GOD HATES DIVORCE: The decision of Mons Romulo Tantoco to seek the annulment of her 21-year old marriage with Sander Tantoco should remind each and every husband everywhere that no matter how happy they may become in finding new relationships, God does not want husbands to separate from the wife of their youth, and for them to sire illegitimate children.

The Holy Bible, in its Malachi 2:15-16, says God makes the husband and wife as one, because He requires godly, not illegitimate, children.


EDSA BOMB BLAST DIRECTED AT PNOY: The theory that a Mindanao politician, wanted by the authorities for allegedly instigating the bombing of a government building years ago to kill his rival, also masterminded the EDSA bomb blast last week to seek a leverage with the Aquino government, is standing on thin ice.

First, there is no way the Aquino government will ever strike a deal with him, just to free him from his involvement in the bombing that resulted in the death of his rival, with five people also ending up dead in the EDSA caper.

Second, bombing a bus on a busy Makati City street does not show a desire to patch things up. Third, the recent EDSA bomb blast is more of a destabilization move, intended to weaken the people's trust in President Aquino, no more, no less.

REAKSIYON SA KOLUM SA QC DECISION: Isa sa mga nagsusulong ng jury system sa Pilipinas ang nagbigay, sa email, ng reaksiyon sa ating isinulat dito ukol sa desisyon laban sa akin ng Quezon City Metropolitan Trial Court, Branch 43: "Hindi na ito dapat pinag-iisipan pa…mayroong sabwatan/lagayang nagaganap, at ito ang problema ng katarungan sa Pilipinas.

"Kung ang Pilipinas ay may jury system, ang magkabilang panig ay maglalaban sa kaso batay lamang sa batas, sa lakas ng ebidensiya, at kung sinuman ang may mas matinding argumento, ang siyang mananalo. Ang tanging dapat gawin ng hukom ay mag-utos ukol sa nalabag na batas at kung ano ang tamang remedyo para sa na-agrabiyado (Rick Bernabe,dlrkng884853@yahoo.com)."


BATAYANG LEGAL JUSTIFICATION SA AFP MONTHLY ALLOWANCES: Ang panayam ng Inquirer sa isang AFP chief of staff sa ilalim ng Pangulong Arroyo na isinagawa ng beteranong mamamahayag na si Christian V. Esguerra ay maaaring tumayong batayang legal sa pagbibigay ng milyon-milyong "buwanang allowances" sa kaninumang AFP chief, at magpapabulaan sa akusasyon ng pandarambong at korapsiyon mula kay Lt. Col. George Rabuza.

Tunay nga, sa bigat ng mga responsibilidad ng isang chief of staff, gaya ng bigat ng mga responsibilidad ng Pangulo ng Pilipinas, saan naman kukunin ng hepe ang pera upang maging maayos ang kanyang pamamahala? Ang Pangulo ay mayroong pondo mula sa PAGCOR at PCSO, pero wala nito ang isang AFP chief.


GALIT SA DIBORSIYO ANG DIYOS: Dapat ipinapaala-ala ng pagpapawalang-bisa ng 21-taong kasal ni Mons Romulo kay Sander Tantoco, sa lahat ng mga lalaki, na gaano man sila kasaya sa pagkakaroon ng bagong ka-relasyon, ayaw ng Diyos na iwanan ng mga lalaki ang kanilang mga asawa mula sa pagkabata, at ang pagkakaroon nila ng mga illehitimong anak.

Sinasabi ng Bibliya, sa kanyang Malakias 2:15-16, ginagawa ng Diyos na iisa lamang ang lalaki at babaeng mag-asawa, sapagkat nais Niya ng mga maka-Diyos, at hindi illehitimong mga anak.


EDSA BOMB BLAST, NAKAPATUNGKOL KAY PNOY: Manipis na yelo, kumbaga, ang kinatatayuan ng teoryang isang politiko mula sa Mindanao na pinaghahanap sa ngayon dahil sa pagkakasangkot niya sa pambobomba ng isang government building noon na nagresulta sa kamatayan ng kanyang kalaban, ang siya ding utak ng EDSA bomb blast upang magkaroon siya ng hawak sa gobyernong Aquino. 

Una, hindi makikipag-usap sa kanya ang gobyerno, upang mailusot siya sa unang pambobombang kinasasangkutan niya na pumatayng kanyang karibal, sapagkat mayroon ding patay sa EDSA bombing, at lima pa.

Pangalawa, ang pambobomba ng bus sa Makati City ay hindi pagpapakita ng pakikipagkasundo. Pangatlo, ang pinakahuling pambobomba sa EDA ay isang destabilization move na layuning pababain ang tiwala ng tao kay Pangulong Aquino, walang labis, walang kulang.
