ISSUES ON QC MTC DECISION: I would like to believe that someone out there really thinks I am already “somebody” who would merit a news article on things happening to me. Take, for instance, the supposed conviction handed down by the Quezon City Metropolitan Trial Court, Branch 43, against me, for alleged “threats to publish a libel”, which newspapers published recently.

The court, through it presiding judge, Manuel Sta. Cruz, Jr., said I committed the “threats to publish a libel” against processed meat producer CDO Foodsphere, Inc., because I allegedly threatened CDO that I will publish official complaints that its meat products contained live worms that made some people sick.

I already appealed the decision of Sta. Cruz, on questions of fact and of law, to the Regional Trial Court of Quezon City, but the news articles about that decision did not mention this appeal at all. The news articles merely focused on the supposed conviction, obviously to discredit me and the people who complained of the live worms.

GRAVE CONSTITUTIONAL PROBLEMS: But the records of the case before Judge Sta. Cruz show grave problems about his decision, and I am writing about these grave problems, already brought beforehand to the attention of the judge in the records, only because of the news articles that came out in the aftermath of the release of that decision to media.

What are these grave problems made of record in the case? The first is the fact that Judge Sta. Cruz did not allow me to present my evidence in the case. He said I should not be allowed to present evidence because my affidavit contradicting the charges against me was not marked.

This of course violates the Constitution, which guarantees the right of an accused like me to be heard and therefore to present my evidence. Why would Judge Sta. Cruz refuse to allow me to exercise my Constitutional right to present my evidence, I asked him earlier?

QUESTIONS POSED BEFORE THE JUDGE: This is especially true because of a peculiar circumstance in that case---CDO Foodsphere Inc. likewise did not mark the affidavits of its witnesses, but Judge Sta. Cruz, invoking “interest of justice”, allowed CDO to present its witness just the same.

I contested this, saying, if Judge Sta. Cruz acted with leniency to favor CDO, why deny me that same leniency? Why did Judge Sta. Cruz allow CDO to present its evidence even if its witness did not mark its affidavit earlier, and barred me from doing the same thing, especially because my affidavit formed part of the record of the case anyway?
And, more importantly, this CDO witness who was allowed to testify even without his affidavit being previously marked even testified he could not really pinpoint if I was the one who allegedly made the threats to publish a libel against it. The question in my appeal now is: if this witness failed to identify me, how come Judge Sta. Cruz dared to convict me?

Mga isyu sa QC MTC decision


INSPIRASYON SA BUHAY: “…panatilihin ang katarungan sa mga hukuman…” (Amos 5:15, Bibliya).

MGA ISYU SA QC MTC DECISION: Nais ko na yatang maniwala na sikat na talaga ako, na ang nangyayari sa akin ay dapat ng mailabas sa diyaryo. Halimbawa na lamang ang sinasabing sentensiyang ibinaba laban sa akin ng Quezon City Metropolitan Trial Court, Branch 43, sa kasong “banta sa paglilimbag ng libelo”, na inilabas ng mga diyaryo nito lamang mga nakakaraang araw.

Sinabi ng korte, sa pamamagitan ng kanyang hukom, Manuel Sta. Cruz, Jr., na ginawa ko daw ang krimen laban sa CDO Foodsphere Inc., tagagawa ng mga processed meat products, sapagkat binantaan ko daw ito na aking ilalabas ang mga opisyal na reklamo laban sa kanyang mga meat products na naglalaman diumano ng mga buhay na uod na diumano ay puminsala sa ilang tao.

Inapela ko na ang desisyon ni Sta. Cruz, pero ang mga news articles ukol sa nasabing desisyon ay hindi man lamang nagbanggit ng apelang ito. Ang mga artikulong ito ay sumentro lamang sa sinasabing sentensiya, upang sirain lamang ang aking kredibilidad at ang kredibilidad ng mga nagreklamo laban sa mga buhay na uod.

GRABENG MGA PROBLEMA SA SALIGANG BATAS: Pero ang record ng kaso sa hukuman ni Judge Sta. Cruz ay nagpapakita ng matitinding problema sa kanyang desisyon, at isinisiwalat ko  na ang mga matitinding problemang ito na ipinarating ko na sa hukom, dahil lamang sa mga naglabasang mga artikulo sa media ukol sa desisyon.

Ano ang mga grabeng problemang ito na nakapaloob na sa record ng kaso? Ang una dito ay ang katotohanang hindi ako pinayagan ni Judge Sta. Cruz na magprisinta ng aking ebidensiya sa kaso. Sabi niya, di ako dapat payagang maglabas ng ebidensiya kasi ang aking salaysay ay di daw namarkahan.

Ito ay isang maliwanag na paglabag sa Saligang Batas, na gumagarantiya sa aking karapatan bilang isang akusado na maglabas ng aking mga katibayan. Bakit tinutulan ni Judge Sta. Cruz ang aking paggamit ng karapatan kong ito sa ilalim ng Konstitusyon, tanong ko sa kanya noon sa kaso?

MGA TANONG SA  JUDGE: Malaking isyu nga ito, lalo na kung titingnan kung ano ang naunang nangyari sa kaso---hindi rin namarkahan ng CDO Foodsphere, Inc. ang affidavit ng kanyang mga testigo, pero, pinayagan ni Judge Sta.  Cruz ang CDO na magpresinta pa rin ng kanyang ebidensiya, batay daw sa “interest ng katarungan”.

Kinuwestiyon ko ito sa pagsasabing kung naging maluwag si Judge Sta. Cruz para paboran ang CDO, bakit naman ipinagkait sa akin ang ganitong kaluwagan? Bakit pinayagan ni Judge Sta. Cruz ang CDO na maglabas ng kanyang ebidensiya, at pinigilan naman niya ako na ganun din ang gawin, lalo na at ang aking salaysay ay matagal ng bahagi ng record?
Ang mas mahalaga pa, ang testigo ng CDO ay nagsabing hindi niya ako maituturo bilang siyang gumawa diumano ng banta upang ilimbag ang libelo. Ang tanong ko sa apela ko ngayon ay ito: kung hindi ako maituro na siyang gumawa ng krimen, bakit sinentensiyahan ako ni Judge Sta. Cruz?
