Marine colonel’s call for PNoy ouster legal?

1987 CONSTITUTION ENCOURAGES FIGHTING LEADERS: As long as the 1987 Constitution retains its so-called people power provisions and the provision granting members of the Armed Forces of the Philippines the status of being “protectors of the Filipino people”, calls for the ouster of President Aquino and any other president after him for that matter will continue.

The reason is that these people power provisions and the Constitutional recognition of the AFP as protectors of the people actually make it legal for anyone, whether civilian, police, or military, to be seeking the ouster of officers of government, as these parts of the Charter virtually scrapped the crime of rebellion, insurrection and other offenses against the state or its government from our statute books.

MARINE COLONEL’S CALL FOR PNOY OUSTER LEGAL? Even now, in view of these legal mandates, I don’t think any criminal or administrative case can be thrown at, or will stick against, Marine Col. Generoso Mariano with his video-taped and media-distributed footage advocating the ouster of President Aquino in view of what he said as his government’s failure to “save the life of the majority”.

If President Aquino wants to stop future adventurism against his regime from the military, the police or from any other sector, he should call for a Constitutional Convention right away and, among others, delete the foregoing provisions from the Constitution which, by a stroke of irony, his own mother promulgated in 1987.

CAN PCSO EXEC PROVE BRIBERY VS. BISHOPS? I hope that Director Aleta Tolentino of the Philippine Charity Sweepstakes Office (PCSO) knows what she is talking about when she lashed at the “bribery and temptation” of Roman Catholic bishops who received donations of sports utility vehicles during the Arroyo administration. I am also hoping that the PCSO would not be engaging in the same “bribery and temptation” under the Aquino government, with Tolentino as a PSCO director.

Indeed, it is easy enough to say that the bishops engaged in “bribery and temptation”, as Tolentino did before media at that, but proving that “bribery and temptation” attended the donation of the SUVs is another matter---especially because the PCSO has the mandate of donating funds, vehicles and other goodies to anyone it takes fancy of, as it has done in the past.

What Tolentino should study now, to determine if “bribery and temptation” are present, are, first, the media advertisements and other donations under the current PCSO board, and see if they are not being used to bribe and tempt mediamen or other parties to side with Tolentino and the PCSO board now. I hope that six years from now, there will be no disclosures about PCSO wrongdoings during Tolentino’s time.

JESUS CHRIST ON JUDGING OTHERS: Our Lord Jesus Christ, in Matthew 7:1-5, has this to say on judging other people: “Do not judge, or you too will be judged…Why do you look at the speck of sawdust in your brother’s eye and pay no attention to the plank in your own eye?

“How can you say to your brother, ‘Let me take the speck out of your eye,’ when all the time there is a plank in your own eye? You hypocrite, first take the plank out of your own eye, and then you will see clearly to remove the speck from your brother’s eye…”

Panawagan ng Marine colonel vs. PNoy, legal?

INSPIRASYON SA BUHAY: “Sapagkat ang pagpapala ng Diyos ay lumitaw at nag-aalay ng kaligtasan sa lahat. Tinuturuan nito tayong magsabi ng `hindi’ sa mga kalapastanganan sa Diyos at sa mga naisin ng mundo, at mamuhay ng may pagpipigil, matuwid at maka-Diyos sa panahong ito, habang hinihintay natin ang banal nating pag-asa---ang muling pagparito ng ating Dakilang Diyos at Tagapagligtas, si Kristo Jesus…” (Tito 2:11-13, Bibliya).

SALIGANG BATAS N 1987, PUMAPAYAG LABANAN ANG MGA LIDER: Habang nananatili sa Saligang Batas ng 1987 ang kanyang mga people-power provisions at ang bahagi nitong kumikilala sa mga kasapi ng Armed Forces of the Philippines bilang mga “tagapagtanggol ng sambayanang Pilipino”, ang mga panawagan sa pagpapatalsik sa Pangulong Aquino at ng iba pang mga susunod na presidente ay magpapatuloy.

Ang dahilan ay ito: ang mga people power provisions na ito at ang pagkilala sa Konstitusyon sa AFP bilang tagapagtanggol ng sambayanan ay nagbibigay ng kapahintulutang legal sa sinuman---sibilyan, pulis o militar---na isulong ang pagpapatalsik ng sinumang opisyal ng gobyerno, sapagkat ang mga bahaging ito ng Saligang Batas ay tila ba nag-alis na sa mga krimeng rebelyon, insureksiyon at iba pang paglaban sa gobyerno.

LEGAL ANG PANAWAGAN NG MARINE COLONEL LABAN KAY PNOY? Kahit sa ngayon, hindi ko nakikitang masasampahan ng kasong kriminal o administratibo si Marine Col. Generoso Mariano matapos siyang maglabas ng isang video tape kung saan iniaanunsiyo niya ang panukalang pagpapatalsik kay Pangulong Aquino dahil diumano sa kabiguan ng kanyang gobyerno na “iligtas ang buhay ng mayorya.”

Kung nais ng Pangulong Aquino na patigilin ang mga adventurismo laban sa kanyang rehimen sa hinaharap mula sa militar, o kapulisan o mula sa iba pang mga sektor, dapat agad siyang magpatawag ng Constitutional Convention at alisin ang mga people power provisions na ito mula sa Saligang Batas na, nakakalungkot mang isipin, ay isinulong naman ng kanyang sariling ina noong 1987.

KAYA BANG PATUNAYAN NG PCSO ANG SUHULAN VS. BISHOPS? Nawa’y tunay na nalalaman ni Director Aleta Tolentino ng Philippine Charity Sweepstakes Office (PCSO) ang kanyang sinasabing “suhulan at tukso” sa mga obispo ng Simbahang Katoliko na tumanggap ng mga mamamahaling sasakyan bilang donasyon sa ilalim ng gobyernong Arroyo. At ako ay umaasang hindi din magkakaroon ng kahalintulad na “suhulan at tukso” sa ilalim ng gobyernong Aquino ang PCSO habang direktor nito si Tolentino.

Tunay nga, madaling akusahan ang mga obispo ng “suhulan at tukso”, gaya ng ginawa ni Tolentino sa harap pa mandin ng media, pero ang pagpapatotoo na nagkaroon nga ng “suhulan at tukso” sa donasyon ng mga sasakyan ay hindi madaling gawin---lalo na at ang trabaho talaga ng PCSO ay magdonasyon ng mga pondo, sasakyan at iba pang bagay sa sinumang nais nitong bigyan.

Ang dapat tutukan ni Tolentino, kung nais talaga niyang pigilan ang “suhulan at tukso”, ay ang mga media advertisements at iba pang donasyon sa ilalim ng kasalukuyang PCSO board, at alamin niya kung nagagamit ang mga ito upang suhulan naman ang mga nasa media o iba pang grupo upang kampihan ang PCSO sa ngayon. Sana, matapos ang anim na taon mula ngayon, walang lalabas na gusot sa PCSO sa panahon ni Tolentino.

SI JESUS AT ANG PANGHUHUSGA NG KAPWA: May mensahe ang Panginoong Jesus sa isyu ng panghuhusga ng ibang tao na mababasa sa Mateo 7:1-5: “Huwag kayong huhusga, dahil kung hindi’y baka kayo naman ang husgahan… Bakit ka nakatingin sa muta sa mata ng iyong kapatid samantalang hindi mo man lamang pinapansin ang putik sa iyong mata?

 “Papano sasabihin sa iyong kapatid, `Aalisin ko ang muta sa iyong mata,’ samantalang mayroong ka naman putik sa iyong mata? Mapagpanggap! Alisin mo muna ang putik sa iyong mata, at doon mo makikita ng mas malinaw ang mutang inaalis mo sa mata ng iyong kapatid…”
