Tingting wants ARMM polls in August

TINGTING COJUANGCO PUSHES ARMM POLLS IN AUGUST: Ms. Margarita “Tingting” Cojuangco, wife of former Tarlac Rep. Jose “Peping” Cojuangco Jr., is pushing for the holding of the August 2011 elections in the Autonomous Region for Muslim Mindanao (ARMM) as part of President Aquino’s commitment to “righteous governance”.

In a roundtable discussion last February 11, 2011 at the Asian Institute of Management (AIM) participated in by Muslim leaders and non-governmental organizations specializing in electoral reforms, Tingting (who is president of the Public Safety College) presented six “compelling reasons” why the ARMM polls must proceed as scheduled this August.

Her first reason: continuing with the electoral exercise in ARMM will be a living testimony of President Aquino’s commitment to the nation, “piliin natin ang daang matuwid” (we must choose righteous governance). Tingting says a fresh mandate for ARMM leaders will allow it to pursue righteous governance.

COMELEC READY FOR ARMM AUGUST POLLS: Second, Tingting said that proceeding with the ARMM elections will send a positive message to the international community, particularly the Organization of Islamic Countries (OIC), since observing regularity of elections, especially in Mindanao, is a sterling feature of democracy and self-determination.

“Third is that, a new mandate for ARMM leaders will give an assurance that justice will be served to the families of the  Maguindanao massacre victims,” Tingting, a known advocate for Mindanao progress through autonomy, also explained.

“Then, the Commission on Elections already announced its readiness to proceed with the ARMM polls, with its P1.8 billion budget,” she said.

LEGAL ISSUES ON ARMM POLL POSTPONEMENT: Tingting’s fifth and sixth arguments dealt with the insurmountable legal problems of postponing the ARMM elections. She said a postponement of the August 2011 elections will require an amendment of Republic Act 9054, or the Expanded ARMM Organic Act.

This act provides for elections in the region every three years. To skirt this timeline, it is necessary for the law to be amended, but such an amendment at this point requires a vote of 2/3 of the members of the House of Representatives and of the Senate voting separately, Tingting explained.

Then again, a postponement would also require an amendment of the 1987 Constitution itself considering that, under its terms as interpreted by the Supreme Court, extending the term limits of local officials by postponing the elections or allowing incumbents as hold-over officers violates the Charter, Tingting clarified.

Tingting: ituloy ang ARMM polls!

TINGTING COJUANGCO, ISINUSULONG ANG ARMM POLLS SA  AGOSTO: Isinusulong ni Ms. Margarita “Tingting” Cojuangco, may-bahay ni dating Tarlac Rep. Jose “Peping” Cojuangco Jr., ang pagpapatuloy ng halalan sa Agosto 2011 sa Autonomous Region in Muslim Mindanao (ARMM) bilang pagtupad sa pangako ng Pangulong Aquino ukol sa “matuwid na pamamahala”.

Sa isang talakayan noong Pebrero 11, 2011 sa Asian Institute Management (AIM) na dinaluhan ng mga lider-Muslim at non-governmental organizations na nakatutok sa reporma sa halalan, nagbigay si Tingting (na pangulo ngayon ng Public Safety College) ng anim na “matitinding dahilan” kung bakit dapat matuloy ang ARMM elections sa Agosto.

Ang kanyang unang dahilan: ang pagpapatuloy ng halalan sa ARMM ay matibay na pagtupad sa pangako ng Pangulong Aquino ukol sa “daang matuwid”. Ayon kay Tingting, ang bagong mandato para sa liderato ng ARMM ay pag-uugatan ng matuwid na pamamahala.

COMELEC, HANDA NA SA ARMM AUGUST POLLS: Pangalawa, niliwanag ni Tingting na ang pagpapatuloy ng ARMM elections sa Agosto ay magdudulot ng positibong mensahe sa buong daigdig, lalo na sa Organization of Islamic Countries, sapagkat magpapakita ito ng katatagan ng demokrasya at pagkilala sa karapatan ng bayan na pumili ng mga lider sa bansa.

“Pangatlo, ang bagong mandato para sa mga ARMM leaders ay magbibigay ng kasiguruhan na magkakamit ng katarungan ang mga pamilya ng mga biktima ng Maguindanao massacre,” ayon din kay Tingting, na kilala bilang isang masusing nagsusulong ng kaunlaran sa Mindanao sa pamamagitan ng autonomiya.

“Ganundin, inanunsiyo na ng Commission on Elections ang kanyang kahandaan sa pagpapatuloy ng halalan sa ARMM, lalo na at mayroon na itong P1.8 bilyon,” dagdag pa niya.

ISYUNG LEGAL SA ARMM POLL POSTPONEMENT: Ang panglima at pang-anim na argumento ni Tingting ay nakasentro sa mabibigat na problemang legal sa pagpapaliban ng ARMM polls. Ayon sa kanya, ang pagpapalibang ito ay mangangailangan ng pagbabago sa Republic Act 9054, o ang Expanded ARMM Organic Act.

Ang batas na ito ay nagtatakda ng halalan tuwing ika-tatlong taon. Upang malampasan ang isyung ito, kailangang amiyendahan ang batas, pero nangangailangan ito ng botong 2/3 mula sa House of Representatives at Senado, sa magkahiwalay na botohan, pagpapaliwanag din ni Tingting.

Panghuli, ang pagpapaliban ng halalan sa ARMM ay mangangailangan din ng pag-amiyenda ng Saligang Batas ng 1987, sapagkat sa ilalim nito, batay na din sa mga desisyon ng Korte Suprema, ang pagpapalawig ng termino ng mga lokal na opisyales batay sa postponement, ay ilegal at di pinapayagan, ayon kay Tingting.
