GMA on Gutierrez: failure or abandonment?

GMA ON GUTIERREZ: FAILURE OR ABANDONMENT? I am sure many of us are now wondering why the allies of former President and now Pampanga Rep. Gloria Macapagal Arroyo failed to stop the House of Representatives justice committee from proceeding with the initial but crucial steps towards the impeachment of Ombudsman Merceditas Gutierrez.

Indeed, the justice committee are composed of known allies of Mrs. Arroyo when she was still in power in Malacanang, and could therefore still be asked to do her bidding, especially in stopping the impeachment process, if only she asked them so.
Do the votes allowing the impeachment process to proceed against Mrs. Gutierrez mean that Mrs. Arroyo did not move to help her erstwhile ally? Or do the votes mean that Mrs. Arroyo has lost her hold on the congressmen who, not so long ago, had professed utmost loyalty to her?

DUTY TO AWAIT SC FINAL VERDICT: The issue of whether or not our congressmen can already proceed with the impeachment of the Ombudsman despite the pendency of her motion for reconsideration with the Supreme Court is actually an unresolved legal point, even up to now.

In the case of Eternal Gardens vs. Court of Appeals and residents of Baesa, Caloocan City, G.R. No. L-50054, August 17, 1988, the Supreme Court said that while it may not  have issued any restraining order against anyone in a case pending before it, it is the duty of everyone in the case to refrain from doing anything in the meantime.

The reason is that, the right of any of the parties in the case before it to do one thing or another is necessarily limited by the filing or the pendency of the Supreme Court case, making it the duty of the said parties to await the final verdict to be handed down by it.

SC HAS THE RIGHT TO SAY WHAT THE LAW IS: Then, it is also now a bedrock law in this country that it is the right of the Supreme Court to tell everyone, whether from the government or from the private sector, what the law is on any given matter.

According to the 1935 case of Angara vs. Electoral Commission, when the Supreme Court declares what should be done under the law, that declaration must be followed by all, because even that declaration becomes the law for everyone.

Through the eminent Chief Justice Jose P. Laurel, the Supreme Court ruled: “In cases of conflict, the judicial department is the only constitutional organ which can be called upon to determine the proper allocation of powers between the several departments and among the integral or constituent units thereof…”

GMA at Gutierrez: kabiguan o pag-abandona?

GMA AT GUTIERREZ: PAGKABIGO O PAG-ABANDONA? Sigurado akong marami sa atin ang nagtataka kung bakit di napigilan ng mga kaalyado ng dating Pangulo at ngayon ay Pampanga Rep. Gloria Macapagal Arroyo ang House of Representatives justice committee sa pagpapatuloy ng proseso ng impeachment laban kay Ombudsman Merceditas Gutierrez.

Tunay nga, ang mga kasapi ng justice committee ay kilalang mga kaalyado ni Gng. Arroyo noong nasa poder pa siya sa Malacanang, at dapat ay kayang-kayang pakiusapan na kumilos ayon sa kanyang kagustuhan, lalo na sa pagpapahinto ng impeachment laban kay Mrs. Gutierrez, kung ginusto lamang niya ito.

Ang mga boto bang nagpapahintulot sa pagpapatuloy ng impeachment laban kay Ombudsman Gutierrez ay nangangahulugang di tinulungan ng dating Pangulo ang Ombudsman? O di kaya naman, ang mga boto bang ito ay nagpapakitang nawala na ang impluwensiya kumbaga ni Mrs. Arroyo sa mga kongresistang dati ng nagpapahayag ng kanilang katapatan sa kanya?

TUNGKULING HINTAYIN ANG PINAL NA DESISYON NG SC: Ang isyung maaari bang magpatuloy na ang mga kongresista natin sa impeachment ng Ombudsman sa kabila ng nakabimbin pa ang motion for reconsideration ng huli sa Korte Suprema ay isang punto sa batas na di pa rin nareresolba hanggang sa ngayon.

Sa kasong Eternal Gardens vs. Court of Appeals, G.R. No. L-50054, August 17, 1988, sinabi ng Korte Suprema na bagamat hindi ito nakapagpalabas ng restraining order laban sa mga nagtutunggali sa isang kasong nakabimbin doon, tungkulin naman ng mga partido na tumigil sa pagkilos muna.

Ang rason dito ay ito: ang karapatan ng lahat ng mga partido sa kaso upang isulong ang kanilang mga ipinaglalaban ay nalilimitahan ng pagkakasampa o pagkakabimbin ng kaso sa Korte Suprema, daan upang maging tungkulin ng lahat na hintayin na lamang muna ang pinal na desisyon ng hukuman.

SC, MAY KARAPATANG SABIHIN KUNG ANO ANG BATAS: Ganundin, matatag ng batas sa bansang ito ang karapatan ng Korte Suprema na sabihin sa  mga nasa gobyerno o pribadong sektor kung ano ang batas sa anumang bagay.

Ayon sa kasong Angara vs. Electoral Commission na nadesisyunan noong 1935, kung magdedeklara ang mataas na hukuman kung ano ang dapat gawin sa ilalim ng batas, ang deklarasyong ito ay dapat sundin ng lahat, sapagkat maging ang deklarasyong ito ay nagiging batas din para sa lahat.

Sa pamamagitan ni Chief Justice Jose P. Laurel, sinabi ng Korte Suprema: “Sa panahon ng gusot, ang hudikatura ang siyang natatanging instrumento sa ilalim ng Saligang Batas na binigyan ng tungkulin upang sabihin kung ano ang hangganan ng mga kapangyarihan ng iba’t ibang departamento ng gobyerno…”
